Recognition of housing costs - judgement LSG Berlin-Brandenburg

The Social Court of Berlin ruled in the case number L 32 AS 1888/17 that the Job Centre must assume the full costs for accommodation if there is no other appropriate accommodation and the accommodation is also not too expensive. The case concerned a woman from Syria who lives with her husband and children in a flat that the Job Centre considers inadequate and therefore only wants to take over part of the rent. The woman had filed a complaint against this decision and was upheld at first instance. The Job Centre then appealed.
The Berlin-Brandenburg Regional Social Court has now ruled that the Job Centre must pay the full costs for accommodation, as there was no other appropriate accommodation for the family and the flat was also not too expensive. The court thus clarified that the Job Centre must also take into account the individual needs of the persons concerned when calculating the reasonable costs for a flat.
